Illegal land grabbers will now be sentenced to 10 to 14 years


Minister Vijay Rupani has made an important announcement at a press conference on the land embezzlement law to curb land mafias, which from now on will give 10 to 14 years imprisonment to illegal land grabbers. The court will hear the case within 6 months. Efforts will be made to ensure the safety of small men.

A committee of 7 officers will be formed for this. The CMA further said that a complaint would be lodged against any defiant person and action would be taken within 20 days of receipt of the complaint. A mandatory meeting will be held every 15 days for this. Special courts will be set up to expedite the disposal of cases and punish the culprits severely.

The government took note of complaints that farmers’ land had been grabbed by land mafias
The Chief Minister gave details of these legal provisions. He made it clear that the government had noticed complaints of land grabbing by ordinary landlords and some incidents of land grabbing by ordinary land mafias, with the intention that no valuable land of any farmer in the state could be usurped by any land mafia. With the firm intention of bringing in as well as teaching them a hard lesson, the state government has ensured the enactment of this strictest criminal law.

Imprisonment for a minimum of 10 years and a maximum of 14 years if convicted
This government does not want to let go of the land mafia or any skinheads rather than engage in criminal activities of illegal land grabbing. Under the law, offenders will now be liable to imprisonment for a minimum of 10 years and a maximum of 14 years from conviction, as well as a fine of up to Rs. It further elaborated on the provisions that have been ensured to make the Land Grabbing Prohibition Act a more comprehensive and stricter punishment and to make it a punishable act.

A committee was formed under the chairmanship of the District Collector
A committee has been constituted under the chairmanship of the District Collector to thoroughly scrutinize the complaints received under the Land Grabbing Act, in which no beneficiary elements have misappropriated the title of the land by making false complaint or application. In addition to the Municipal Commissioner and the Commissioner of Police, the CEO of the Urban Development Authority will be a member of the committee.

The committee will have to take a decision within 21 days of receiving the complaint
Action can be taken against land mafias in the state without any embarrassment or pressure. The meeting of this committee will be held compulsorily every 15 days. Not only that, it will also report whether such land has been acquired through coercion, intimidation, greed or fraud. The committee will have to take a decision within 21 days of the submission of such investigation report before the committee chaired by the district collector. A complaint must be lodged by a police officer within 7 days.

Within 30 days of the filing of the FIR, the full indictment has to be submitted to the special court for implementation of this Act. Crimes under this Act will be investigated by an officer of the rank of Deputy Superintendent of Police (DYSP). Special courts have been set up to expedite the disposal of cases, punish the perpetrators severely and provide appropriate compensation to the affected person. The Chief Minister added that in such cases of land grabbing, it is imperative that the culprits be punished swiftly and justice be served. For this purpose, it has been decided to set up a special court to expedite the hearing of such land grabbing cases and punish the land mafias severely.

With all the powers, special courts will be able to take strict action against land mafias
A public prosecutor will also be appointed in each special court for expeditious hearing of such cases in the special court. Since the special courts have been given the power of civil and criminal courts, strict action can be taken against the land mafias. At the same time, the land of an innocent person, a farmer, a rural citizen who has been usurped will get compensation as well as speedy justice. According to another important provision of the Act, a person accused of land grabbing in a land grab case has to prove to the court that he has not forfeited such land himself.

The CMA further said that the effective implementation of the provisions of the Act with immediate effect would result in illegal occupation of lands, financial assistance for illegal construction on such lands as well as recovery of rent, compensation or other assistance from the occupants of such lands under criminal intimidation. Individuals will be included in the definition of land grabber. In order to accelerate the overall development journey of cities-towns-metropolises in Gujarat, industry-trade-agriculture-animal husbandry as well as employment opportunities have been created in the name of building the best of Gujarat through maximum proper use of lands. Implementation of Gujarat Land Grabbing Prohibition Act will be a new milestone in realizing this name.
